Terms of Service
Effective date: [the day you launch] · Last updated: October 12, 2026
Heartchu is for adults only (18+)
You must be at least 18 years old, and an adult where you live, to make an account, view, or use Heartchu. If you are under 18, leave now. We permanently ban anyone we believe is under 18, even after they turn 18.
We have zero tolerance for anything that sexualizes, exploits or endangers anyone under 18. That includes images, video, live cams, chat, links, "age play" role-play, and talking about it. We remove it, ban the account, and report it to the National Center for Missing & Exploited Children (NCMEC) and law enforcement, as federal law requires. If you see anything like this, report it right away with ⚠ Report. If someone is in immediate danger, call 911.
Please read the arbitration agreement
Section 21 says that most disagreements between you and Heartchu will be decided by a neutral arbitrator, one person at a time, instead of in court or in a class action, and that you and we give up the right to a jury trial. There are exceptions, including small-claims court. You can opt out within 30 days of making your account. Section 21 explains how.

1. Agreeing to these Terms
These Terms of Service ("Terms") are a binding agreement between you and Heartchu ("Heartchu," "we," "us"). They cover the Heartchu website and everything on it (the "Service").
By creating an account, ticking the box at sign-up, or using the Service, you agree to these Terms and to our Privacy Policy, which is part of these Terms. If you don't agree, don't use Heartchu.
2. What Heartchu is
Heartchu is a social website for adults. Members make their own profile pages and can:
- customize their page's colors, write an About me, and post photos, moments, videos, music and voice notes;
- post on Explore and in topics, follow people, and see a Friendly feed;
- send private messages (Pm's) and texts through the Heartchu dial;
- go live on cam or audio, join other people's cams, and talk in Live Chat;
- host and join cam parties, including 18+ parties and watching videos together;
- show their own tip links.
Members create everything you see here; we don't. We provide the tools, set the minimum rules needed to follow the law and keep people safe, and remove what breaks them. Some features cost nothing to use today; if we ever add paid features, we'll tell you the price and terms before you pay.
3. Who can use Heartchu
You can use Heartchu only if all of these are true:
- you are at least 18 and an adult where you live;
- you can form a binding contract, and the law where you live allows you to use a service like this one, including seeing adult content if you choose to;
- you are not on any sex-offender registry and have never been convicted of a sex crime;
- we haven't banned you before, and you aren't barred from using U.S. services under U.S. sanctions law.
4. Minors and child safety
For these Terms, "child sexual abuse material" (CSAM) includes any image, video, livestream, drawing, animation, AI-generated or edited image, text or audio that shows, describes or suggests a person under 18 in a sexual way or undressed, and any adult made to look or act like a minor in a sexual way. Possessing or sharing CSAM is a serious crime under federal and Washington law.
On Heartchu, and when arranging anything on other sites through Heartchu, you may not:
- post, stream, link to, ask for, offer or talk about CSAM or the sexual exploitation of anyone under 18;
- role-play as, or ask anyone to role-play as, a minor in any sexual or romantic context;
- show a minor on cam, in a photo, in a video, or in a cam party, even in the background;
- appear (on purpose or not) to be under 18 in a sexual context, through makeup, clothes, props, filters or anything else;
- try to contact, groom or meet anyone you believe is under 18.
We remove this content immediately, permanently ban the accounts involved, keep the evidence the law requires, and report to NCMEC and law enforcement. If you think someone on Heartchu is under 18, report them right away.
5. Consent, trafficking and coercion
Everyone who appears on Heartchu must be an adult who freely chose to be there and to be seen. We have zero tolerance for human trafficking, sex trafficking, or anyone being pressured into appearing. Consent doesn't count if it was given because of threats, violence, money or housing pressure, a partner's or third party's pressure, or while someone was drunk, high or otherwise unable to decide. You may not show anyone on cam, or in any photo or video, who hasn't agreed to it. You may not role-play or promote trafficking, sexual violence or abuse. Breaking this section means a permanent ban and a report to law enforcement.
6. Your account
Making it
Give us true information at sign-up, including your real date of birth. Your username can't pretend to be someone else, use someone else's trademark, suggest anything illegal or sexual involving minors, or break these Terms. We can refuse or take away any username.
Keeping it safe
Keep your password secret. You're responsible for everything done through your account. Tell us right away if you think someone else got into it. We will never ask for your password. Log out on shared devices.
One person, one account
Your account is just for you. Don't share it, sell it, or make extra accounts to get around a ban, block, kick or hold.
7. Adult (18+ / NSFW) content
Some parts of Heartchu can contain nudity and sexual content between adults: 18+ topics and posts on Explore, and cam parties marked 18+. These parts are hidden unless you choose to see them, and you'll be asked to confirm you're 18 each time you go into an 18+ cam party. By choosing to see them, you confirm that you want to see adult content, that it's legal for you to see it where you are, and that it fits your community's standards. If it doesn't, stop using those parts of Heartchu.
Adult content may only be posted where it's allowed: in NSFW/18+ topics and in cam parties marked 18+. It is not allowed on profile pages, profile pictures, the Friendly feed, public live chat, or anywhere marked for everyone. If you start a cam party and it will have adult content, you must mark it 18+.
If you post or stream real sexually explicit content, you are its producer, and you alone are responsible for following federal record-keeping law (18 U.S.C. § 2257) and any other law that applies to it, including making sure everyone shown is an adult who agreed to be shown.
8. Live cams, audio live and recording
- When you go live (on cam or on Audio live with your profile picture), anyone allowed in that room can see and hear you in real time.
- Heartchu has a Record button, and when someone in the room is recording, Heartchu shows a notice saying who. But anyone can also record, screenshot or re-share you with other tools, without permission and without Heartchu knowing. We can't stop that. Don't show or say anything you wouldn't want saved.
- If you record someone, you may only keep it for yourself. You may not post, share or sell another member's stream, picture or voice without their permission. Doing so can also be a crime.
- Page owners and party hosts control their own rooms: who has a cam, who gets muted, who gets kicked, and how many cams there are.
9. Cam parties and watch together
- A cam party lasts up to 24 hours, and you can host one at a time. The host chooses its type, whether it's 18+, whether it needs a password, and who gets in.
- Passwords and "private" parties keep casual visitors out, but they are not a guarantee of privacy. Anyone let in can record or share what they see.
- The host is responsible for what happens in their party, including marking it 18+ when needed and everything they put on the big screen with watch together.
- Watch together shows videos and websites that belong to other people (YouTube, Twitch, other sites, or a video file). Only show things you are allowed to show, and follow those sites' own rules. Don't use watch together to show pirated movies, shows or sports, or anything that breaks these Terms.
- A host can kick someone out of their party for good. We are not involved in a host's decision to let someone in or keep them out, unless it breaks these Terms.
10. Live chat, PMs and the Heartchu dial
- Live Chat messages are deleted automatically 3 hours after they're sent. Heartchu dial messages disappear after 24 hours.
- Even so, treat everything you send as if it could be copied. Other people can screenshot or save anything you send them, and when a message is reported, we save a copy of it and the messages around it to review the report.
- No one has to tell you their real name, age, location or anything else, and some people share made-up details. Don't assume someone is who they say they are.
- Don't send people sexual content they didn't ask for, don't spam, and stop messaging anyone who asks you to stop.
11. Tips and money between members
Heartchu doesn't sell anything or handle any money. A member can show their own tip links (like Cash App, PayPal or Venmo). Any money you send goes straight through that outside service, under its terms. Heartchu is not part of the payment and can't see it, refund it, cancel it, or settle disagreements about it. Send money only to people you trust, and only as a gift.
You may not use Heartchu or tips to buy or sell sex, sexual meetings, "escorting," or any illegal product or service, or to pressure anyone into doing anything. You may not ask anyone for money with threats, guilt or lies (for example, "sextortion" or romance scams). We ban accounts that do this and may report them.
12. Your content and the license you give us
What's yours stays yours
"Your Content" is anything you post, upload, stream or send on Heartchu: your page, photos, videos, music, voice notes, posts, chats, messages, streams and profile details. You keep ownership of Your Content.
What you promise about it
You promise that you created Your Content or have every right and permission needed to post it, including the music you upload to your player, and the permission of every person who appears in it; and that it doesn't break the law or these Terms.
The license you give us
So that we can run Heartchu, you give us a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to host, store, copy, display, perform, stream, adapt (for example, resize or convert) and distribute Your Content, in any form, in order to:
- run, show, secure and improve the Service, and develop new features;
- keep Heartchu safe, including through automated and AI tools that help us find spam, abuse, CSAM and other rule-breaking content, as described in our Privacy Policy;
- promote Heartchu. We will not use your face, body, voice or 18+ content in ads for Heartchu without asking you first.
This license ends when Your Content is deleted from Heartchu, except for copies we must keep for legal reasons, content already shared with or saved by other members, and reasonable backup copies that are deleted on our normal schedule. Other members may see and interact with Your Content in the ways the Service allows (for example, sharing a public post where sharing is allowed). We don't sell Your Content.
We may remove content
We don't check everything before it appears and we don't endorse anything members post. But we may remove or limit any content, at any time, if we believe it breaks the law or these Terms or puts people at risk.
13. Rules of conduct
Besides everything above, you may not:
- harass, bully, threaten, stalk, dox (share someone's private details) or intimidate anyone;
- post hate speech or attack people for their race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation or similar traits;
- share someone's intimate images without their consent, or threaten to;
- post real violence, gore, self-harm encouragement, animal cruelty, bestiality, incest or non-consensual sexual content (real or role-played);
- show illegal drug use or sell drugs, weapons or other regulated goods;
- impersonate anyone, including Heartchu staff, or lie about your identity to trick or hurt someone;
- scam, phish, spam, or post malware or harmful links;
- use bots, scrapers or automated tools to collect data from Heartchu or to create accounts, posts or messages;
- try to break into, overload, test the security of, or get around the limits of Heartchu (for example, its 18+ checks, passwords, blocks, kicks or holds);
- advertise other live-cam or adult services, or use Heartchu mainly for business advertising;
- break any law, or help anyone else break these rules.
14. Safety, privacy and meeting people
- Think before sharing personal details like your full name, address, workplace, school, phone number or financial information. We can't control what other people do with what you share.
- Your profile page, public posts, cams and chat can be seen by others. Even "private" places (PMs, the dial, password-protected parties) can be screenshotted or recorded by the people you share them with.
- Meeting people from Heartchu, online or in person, is at your own risk. If you do meet someone: meet in a busy public place, get there on your own, tell a friend where you'll be, and leave if anything feels wrong. Never send money to someone you haven't met.
- We can't settle disagreements that happen off Heartchu, and we can't verify screenshots from other apps.
- How we collect, use and protect your information, including any health-related information under Washington's My Health My Data Act, is explained in our Privacy Policy.
15. Reports, moderation and enforcement
- Use ⚠ Report on a page, post, cam, message or party to tell us about anything that breaks these Terms. We review reports as soon as we can. You can also email Heartchuassistance@hotmail.com.
- When you report something, we may keep copies of the reported content, related messages and the account's details (including the internet addresses used) to review it and, where the law requires or allows, give it to law enforcement.
- Depending on what happened, we may remove content, give a warning, put a page on hold ("Under review") while we look into it, limit features, or suspend or permanently end an account, with or without notice. We may also report things to law enforcement.
- Blocking and kicking are tools members use on their own pages and parties. They aren't decisions by Heartchu.
- If you think we made a mistake, email Heartchuassistance@hotmail.com and tell us why. We'll take another look.
16. Copyright (DMCA) and intimate images
Copyright complaints
We respect copyright, and we expect members to as well, including for music uploaded to profile players. If you believe something on Heartchu copies your work without permission, send our Copyright Agent a notice that includes:
- your physical or electronic signature;
- the work you say was copied;
- where it is on Heartchu (a link is best);
- your name, address, phone number and email;
- a statement that you believe in good faith the use isn't allowed by the owner, its agent or the law; and
- a statement, under penalty of perjury, that your notice is accurate and that you're the owner or allowed to act for the owner.
Copyright Agent: Heartchu, [mailing address], Heartchuassistance@hotmail.com.
Counter-notices
If we removed your content and you believe it was a mistake or that you had the right to post it, you can send the Copyright Agent a counter-notice with your signature; what was removed and where it was; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; and your name, address, phone number and email, plus a statement that you agree to the jurisdiction of the federal court for your address (or for [county] County, Washington, if you live outside the U.S.) and will accept service from the person who sent the notice. We may then restore the content in 10 to 14 business days unless the other person tells us they've filed a lawsuit.
Repeat infringers
We end the accounts of members who repeatedly infringe other people's rights.
Intimate images shared without consent
If an intimate image or video of you is on Heartchu without your consent (including a fake or AI-made one), email Heartchuassistance@hotmail.com with a link to it and a statement that you're the person shown (or acting for them) and didn't consent. We will remove it, and reasonable copies we can find, within 48 hours of a valid request, as federal law requires. You can also ask us to remove content you appear in that you agreed to before but no longer want shared.
17. Other websites and embedded content
Heartchu shows links and content from other websites, for example YouTube or Twitch videos in posts, profiles and watch together, and links members post. Those sites aren't run by us. We don't control or endorse them, they have their own terms and privacy policies, and you visit them at your own risk. We may limit or block links or sites.
18. Ending your account
By you
You can deactivate or delete your account at any time in ⚙ Settings. Once it's deleted, your page and content are gone from Heartchu for good, except as described in section 12 and our Privacy Policy.
By us
We may suspend or end your account, or your access to any part of Heartchu, at any time, for breaking these Terms, for anything we reasonably believe is illegal, harmful or fraudulent, to protect members or Heartchu, or if we stop running the Service. When an account ends, we don't have to keep or hand back any of its content.
Sections 4, 5, 12 (the parts that should survive), and 16 through 23 still apply after your account ends.
19. Disclaimers and limits on our liability
HEARTCHU IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON'T PROMISE THAT HEARTCHU WILL ALWAYS WORK, BE SECURE OR BE FREE OF ERRORS, OR THAT ANY CONTENT IS ACCURATE OR SAFE. WE ARE NOT RESPONSIBLE FOR WHAT MEMBERS OR OTHER WEBSITES POST, SAY OR DO, ON OR OFF HEARTCHU.
TO THE FULLEST EXTENT THE LAW ALLOWS, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF (OR INABILITY TO USE) HEARTCHU OR FROM ANY MEMBER'S CONDUCT, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100).
Nothing in these Terms limits liability for our gross negligence, willful misconduct or fraud, or any right you have that the law (including the Washington Consumer Protection Act) doesn't allow to be limited or waived.
Heartchu is an online service that hosts content made by members. Under federal law (47 U.S.C. § 230), we are generally not treated as the publisher or speaker of what members post.
20. Indemnity
If someone brings a claim against us because of Your Content, your use of Heartchu, or your breaking these Terms or the law, you agree to cover our losses and reasonable costs (including attorneys' fees) for that claim, to the extent the law allows. We'll let you know about the claim and may choose to handle our own defense.
21. Arbitration and class-action waiver
Try us first. Before starting any claim, email Heartchuassistance@hotmail.com describing the problem and what you want. We'll try to work it out with you for at least 30 days.
Arbitration. If we can't, you and Heartchu agree that any dispute about Heartchu or these Terms will be settled by binding individual arbitration, not in court, except as listed below. The arbitration will be run by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (adr.org), and the Federal Arbitration Act governs this section. It can happen by video or phone, or in person in the county where you live. For claims under $10,000 we will pay the AAA filing, administration and arbitrator fees, unless the arbitrator finds your claim was frivolous. An arbitrator can award you the same individual relief a court could. There is no judge or jury, and courts can only review an arbitrator's decision in limited ways.
Exceptions. Either of us can instead (a) bring an individual claim in small-claims court, or (b) go to court about intellectual property or to stop the misuse of the Service (for example, hacking or scraping). Nothing here stops you from reporting anything to a government agency.
No class actions. You and Heartchu may bring claims only on your own behalf, not as a plaintiff or class member in any class, group or representative action, and an arbitrator may not combine people's claims. If this class waiver is found unenforceable for a claim, that claim goes to court, not to arbitration.
Opting out. You can opt out of this section within 30 days of making your account by emailing Heartchuassistance@hotmail.com from your account's email address with your username and the words "I opt out of arbitration." Opting out doesn't change the rest of these Terms.
22. Washington law and where disputes go
These Terms are governed by the laws of the State of Washington and the United States, without regard to conflict-of-law rules. Any dispute that isn't arbitrated will be heard only in the state or federal courts located in [county] County, Washington, and you and we agree to those courts' jurisdiction. If you live outside the U.S., some laws where you live may still protect you.
23. Changes, contact and the rest
- Changes to these Terms. We may update these Terms. If a change is important, we'll tell you on Heartchu (for example, with a pop-up or a message from Heartchu) before it takes effect. If you keep using Heartchu after that, you accept the new Terms. If you don't, stop using Heartchu and delete your account. Changes to section 21 won't apply to disputes we already knew about.
- Changes to Heartchu. We may add, change or remove features at any time.
- The whole agreement. These Terms and the Privacy Policy are the whole agreement between you and us about Heartchu.
- If part doesn't hold up. If a court or arbitrator finds part of these Terms unenforceable, that part will be changed only as much as needed, and the rest stays in effect.
- No waiver. If we don't enforce something right away, we haven't given up the right to enforce it later.
- Transfers. You can't transfer these Terms or your account. We can transfer them, for example if Heartchu is sold.
- Contact. Heartchu, [mailing address], Washington. Support: Heartchuassistance@hotmail.com. Legal notices: Heartchuassistance@hotmail.com.
